• Delivery of products can be arranged either by the buyer, who may collect the goods from our premises once notified that the goods are ready for collection, or by the company delivering to an agreed location, in accordance with the chosen Incoterms (FOB, CIF, CNF) under Incoterms 2020. All dates provided for product delivery are approximate, and we are not liable for any delays, regardless of the cause. Delivery time is not considered an essential term of the contract unless explicitly agreed to by BI-Trade GmbH in writing. Products may be delivered earlier than the specified date, with reasonable notice given to the buyer.

• In cases where products are delivered in installments, each installment constitutes a separate contract. Any failure by BI-Trade GmbH to deliver one or more installments, or any claim by the buyer regarding one or more installments, will not entitle the buyer to repudiate the entire contract. Additionally, it will not release the buyer from their obligations under these conditions.

• If we are unable to deliver the products for reasons beyond our control or due to fault on the part of the buyer, and BI-Trade GmbH is held liable, our liability will be limited to the amounts paid by the buyer under the contract. BI-Trade GmbH will not be held liable for any failure by a designated shipping agency to deliver the products or for any related violations.

• If the buyer fails to take delivery of the products or provide adequate delivery instructions at the agreed time, BI-Trade GmbH reserves the right to:

  • Store the products until actual delivery and charge the buyer for reasonable storage costs, including insurance; or
  • Sell the products at the best available price and, after deducting all reasonable storage and selling expenses, either credit the buyer with any excess over the contract price or charge the buyer for any shortfall below the contract price.

Under Incoterms 2020, BI-Trade GmbH ensures clarity and efficiency in all shipping and delivery processes.
